Novelcrafter Early Access Program Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your participation in the Novelcrafter Early Access Program (“Program”) and your use of preview features provided by Novelcrafter. These Terms are in addition to and do not replace the general Terms and Conditions for the use of Novelcrafter’s app.

2. Acceptance of Terms

By participating in the Program and using any preview features, you accept and agree to be bound by these Terms. If you disagree with any part of these Terms, you must not participate in the Program or use any preview features.

3. Preview Environments and Data Loss

3.1. Novelcrafter provides preview features and environments on an “as is” and “as available” basis.

3.2. You acknowledge and agree that Novelcrafter is not responsible for any data loss, corruption, or other issues that may occur in preview environments. You are solely responsible for backing up any important data before using preview features.

3.3. Novelcrafter disclaims all warranties and liabilities related to data loss or corruption in preview environments to the fullest extent permitted by law.

4. Non-Disclosure Agreement (NDA) and Communication

4.1. By participating in the Program, you agree to keep all information related to preview features, including their existence, functionality, and performance, strictly confidential.

4.2. You agree not to share, discuss, or disclose any aspect of the preview features with any third party outside of the Program, including but not limited to social media, forums, or other public platforms.

4.3. You are permitted and encouraged to discuss the preview features with: a) Novelcrafter representatives and employees b) Other participants in the same Early Access Program

4.4. All discussions and communications about the preview features must be conducted through channels provided or approved by Novelcrafter for this purpose.

4.5. When communicating with other participants, you must not share any personal information or access credentials related to your account or the Program.

4.6. Novelcrafter may moderate, monitor, or participate in discussions between Program participants to gather feedback and provide support.

4.7. This non-disclosure obligation remains in effect during the entire duration of the preview period and continues indefinitely after the preview ends or your participation in the Program terminates, except for information that Novelcrafter makes publicly available.

5. Opting Out

5.1. You may opt out of the Program at any time by contacting Novelcrafter’s customer support at support@novelcrafter.com.

5.2. Upon opting out, you will lose access to all preview features, but your obligations under the NDA will continue as specified in Section 4.

6. Duration of Terms

6.1. Your acceptance of these Terms is considered indefinite. However, the specific obligations related to the NDA (Section 4) and your experience with preview features are limited to the duration of the preview period.

6.2. Novelcrafter reserves the right to terminate the preview period at any time without prior notice.

7. Intellectual Property Rights

All intellectual property rights related to the preview features remain the sole property of Novelcrafter. Your participation in the Program does not grant you any rights to the preview features beyond the limited right to use them as specified by Novelcrafter.

8. Limitation of Liability

To the fullest extent permitted by law, Novelcrafter shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of or inability to use the preview features.

9. Indemnification

You agree to indemnify and hold harmless Novelcrafter and its employees from any claims, damages, or expenses arising from your violation of these Terms or misuse of the preview features.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Germany. Any disputes arising out of or related to the Program or these Terms will be subject to the exclusive jurisdiction of the courts of Germany.

11. Changes to Terms

Novelcrafter reserves the right to modify these Terms at any time. You will be notified of any significant changes, and continued participation in the Program after changes are made constitutes acceptance of those changes.
