Novelcrafter Early Access Program Terms of Service

A Quick Note in Plain Language

Legal documents can be dense, so we wanted to start with a straightforward summary. The full legal terms below are the ones that officially apply, but this is the spirit behind them:

  • Your Work is Yours, Always: You own 100% of the rights to your writing. We never claim any copyright to your novels, characters, or any other content you create.
  • Help Us Build a Better Tool: To find and fix bugs in this early version, you give us temporary, limited permission to let us and our systems analyze your content for internal development purposes only. We will guard your work as if it were our own and will never use it for marketing, share it, or sell it.
  • Early Software Has Bugs: This is a preview, not the final version. Unexpected issues can happen, so please keep regular backups of your work. Your writing is precious, and it’s best to have a copy stored safely elsewhere while we work out the kinks together.

Terms of Service

1. Introduction

These Terms of Service (“EAP Terms”) govern your participation in the Novelcrafter Early Access Program (“Program”) and your use of any pre-release, beta, or preview software, services, or features provided by Novelcrafter (“Preview Features”). These EAP Terms supplement and are incorporated into the main Novelcrafter Terms of Service (“General Terms”). In case of any conflict between these EAP Terms and the General Terms, these EAP Terms will take precedence regarding the Program and Preview Features.

2. Acceptance of Terms

By participating in the Program or using any Preview Features, you accept and agree to be bound by these EAP Terms. If you do not agree with any part of these EAP Terms, you may not participate in the Program or use any Preview Features.

3. Preview Features and Potential for Data Issues

3.1. You understand that Preview Features are provided on an “as is” and “as available” basis and may contain bugs, errors, and other issues. They are not the final, production versions of features.

3.2. A Note on Data Safety: You understand and acknowledge that using pre-release software comes with inherent risks, including the potential for data loss or corruption. Because Preview Features are not the final version, we strongly recommend you maintain regular backups of your work outside of Novelcrafter.

3.3. To the fullest extent permitted by law, Novelcrafter disclaims all warranties, express or implied, and liabilities related to the stability, functionality, or data integrity of the Preview Features.

4. Content Ownership and License Grant

4.1. You Retain Ownership: You retain full ownership and all intellectual property rights to the content you create, upload, or store while using Novelcrafter, including any content created within the Program (“User Content”). We do not claim any copyright to your work.

4.2. Limited License to Novelcrafter: To help us improve our services, you grant Novelcrafter a limited, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and analyze your User Content solely for internal purposes. These purposes are strictly limited to testing, developing, and improving our current and future products and services.

4.3. Use of Anonymized Data: We may also use anonymized and aggregated data derived from your User Content for analytical and statistical purposes.

4.4. Protection of Your Content: We will treat your User Content with the same level of care as we treat our own confidential information and will not use it for any purpose other than those stated in this section. This license does not grant us the right to sell your User Content or use it for marketing or promotional purposes without your explicit prior consent.

5. Feedback

We are building Novelcrafter for you, and your feedback, comments, and suggestions (“Feedback”) are invaluable to that process. When you provide Feedback, you agree that Novelcrafter is free to use it to improve the platform for everyone without any obligation or compensation to you. We appreciate you sharing your insights to help us grow.

6. Opting Out

You may opt out of the Program at any time by ceasing your use of Preview Features and, if applicable, notifying Novelcrafter’s customer support at support@novelcrafter.com. Upon opting out, you will lose access to the Preview Features. The licenses granted by you in Section 4 will survive only as they apply to content created during your participation.

7. Termination

Novelcrafter reserves the right to modify, suspend, or terminate the Program or your access to any Preview Features at any time, for any reason, without prior notice, particularly to protect the integrity of our service or in cases of misuse.

8. Intellectual Property of Novelcrafter

All intellectual property rights in and to the Preview Features and the Novelcrafter platform remain the sole property of Novelcrafter. Your participation in the Program grants you only a limited, revocable right to use the Preview Features as specified in these EAP Terms.

9. Limitation of Liability

To the fullest extent permitted by law, Novelcrafter, its affiliates, and its employees shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your participation in the Program or your use of (or inability to use) the Preview Features.

10. Indemnification

You agree to indemnify and hold harmless Novelcrafter and its employees from any claims, damages, liabilities, or expenses (including legal fees) arising from your violation of these EAP Terms or your misuse of the Preview Features.

11. Governing Law and Jurisdiction

These EAP Terms are governed by and construed in accordance with the laws of Germany. Any disputes arising out of or related to the Program or these EAP Terms will be subject to the exclusive jurisdiction of the courts located in Germany.

12. Changes to these Terms

Novelcrafter reserves the right to modify these EAP Terms at any time. We will provide notice of significant changes. Your continued participation in the Program after such changes are posted constitutes your acceptance of the new EAP Terms.
